1. Acceptance of Terms
TL;DR: By using Nova, you agree to follow these rules. We're a small team doing our best — please be reasonable.
By creating an account or using any part of Nova (the "Platform"), you confirm that you have read, understood, and agree to be bound by these Terms of Service ("Terms"), our Community Guidelines, and our Privacy Policy. We may update these Terms from time to time. Continued use after changes constitutes acceptance.
2. Eligibility
TL;DR: You must be at least 13 years old. If you're under 18, get a parent's permission.
You must be at least 13 years of age to use Nova. If you are under the age of 18, you represent that you have your parent or legal guardian's permission to use the Platform. We reserve the right to terminate accounts that violate this requirement.
3. Your Account
TL;DR: Keep your password safe. You're responsible for what happens on your account. Don't share accounts.
- You are responsible for maintaining the security of your account and password.
- You are responsible for all activity that occurs under your account.
- You may not share, sell, or transfer your account to another person.
- You may not create multiple accounts to evade bans or restrictions.
- If you believe your account has been compromised, contact us immediately.
4. User Conduct
TL;DR: Don't be a jerk. PG-13 standards apply. Swearing is fine, hate speech and illegal content are not. See our Community Guidelines for details.
You agree not to use Nova to:
- Harass, bully, threaten, or intimidate other users
- Post or share content that is illegal, sexually explicit, or depicts extreme violence
- Impersonate another person, entity, or Nova staff
- Spread malware, phishing links, or attempt to compromise the Platform's security
- Exploit bugs or vulnerabilities for personal gain (report them instead — we appreciate it)
- Spam, advertise, or solicit other users
- Engage in any activity that violates applicable laws or regulations
Nova operates on PG-13 standards. Mild profanity is permitted in chat and user-created content. Our filtering system is intentionally relaxed compared to other platforms. See our Community Guidelines for a full breakdown.
5. User Content
TL;DR: You own what you create. We need a license to display it on the Platform. We can remove content that breaks the rules.
- You retain ownership of any content you create, upload, or share on Nova ("User Content").
- By posting User Content on Nova, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content solely for the purpose of operating and improving the Platform.
- We reserve the right to remove any User Content that violates these Terms or our Community Guidelines, at our discretion.
- We are not responsible for User Content posted by other users.
6. Game Creations
TL;DR: Games you build are yours. We can feature them or remove them if they break rules. Don't steal other people's work.
- Games and experiences you create on Nova are your intellectual property.
- By publishing a game on Nova, you grant us the right to host, display, and distribute it through the Platform.
- You may not upload content that infringes on the intellectual property rights of others.
- We reserve the right to remove or unpublish games that violate our guidelines.
7. Virtual Currency and Items
TL;DR: Virtual items have no real-world value. We can adjust the economy if needed. No refunds on virtual purchases.
- Nova may include virtual currency and virtual items.
- Virtual currency and items have no real-world monetary value and cannot be exchanged for real money.
- We reserve the right to modify, manage, or terminate virtual currency and items at any time.
- All virtual purchases are final. Refunds are handled on a case-by-case basis at our discretion.
8. Third-Party Services
TL;DR: We link to other services sometimes. We're not responsible for what they do.
Nova may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or availability of such third-party services. Use them at your own risk.
9. Disclaimers
TL;DR: Nova is provided "as is." We're a small team and things might break. We'll try our best.
- Nova is provided on an "as is" and "as available" basis without warranties of any kind.
- We do not guarantee that the Platform will be uninterrupted, secure, or error-free.
- We are not responsible for the actions, content, or conduct of other users.
- We make no warranties regarding the accuracy or reliability of any content on the Platform.
10. Limitation of Liability
TL;DR: If something goes wrong, our liability is limited. We're a small indie project, not a corporation with deep pockets.
To the fullest extent permitted by law, Nova, its developers, contributors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, revenue, or profits, arising from your use of the Platform.
Our total liability to you for any claim arising from these Terms or your use of Nova shall not exceed the amount you paid us in the 12 months preceding the claim, or $50 USD, whichever is greater.
11. Termination
TL;DR: We can suspend or delete your account if you break the rules. You can delete your account whenever you want.
- We may suspend or terminate your account at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to the Platform or other users.
- You may delete your account at any time through your account settings.
- Upon termination, your right to use Nova ceases immediately. We may retain certain data as required by law or for legitimate operational purposes (see our Privacy Policy).
12. Indemnification
TL;DR: If you get us into legal trouble because of your actions on Nova, you cover the costs.
You agree to indemnify and hold harmless Nova, its developers, contributors, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Platform, your violation of these Terms, or your violation of any rights of a third party.
13. Governing Law and Disputes
TL;DR: We'll try to work things out informally first. If we can't, disputes go to small claims court or binding arbitration.
- These Terms are governed by the laws of the jurisdiction in which the Platform operators reside, without regard to conflict of law principles.
- Before filing any formal legal action, you agree to first contact us and attempt to resolve the dispute informally.
- Any disputes that cannot be resolved informally shall be resolved through binding arbitration or small claims court, at the election of either party.
14. Changes to These Terms
TL;DR: We can update these terms. We'll let you know when we do.
We reserve the right to modify these Terms at any time. If we make material changes, we will notify users through the Platform or via email. Your continued use of Nova after changes are posted constitutes acceptance of the updated Terms.
